Hayden Man Charged With Third DUI

A Hayden man has been charged with third DUI following his arrest earlier on Monday evening, March 15. The man has been identified by the authorities as Anthony D. Housley, 40. On Tuesday, March 16, a court ordered that Housley’s bail be set at $60,000.

According to the details shared by the police, Housley was stopped for an alleged traffic violation. After he was stopped, the officer who had stopped him spotted an open container of alcohol in the front center console. Housley was then asked to step out of the vehicle but he couldn’t walk properly.

These symptoms prompted the officers to ask Housley for a breath sample to test him for blood alcohol concentration (BAC). The legal limit for BAC in Idaho is 0.08, and a driver with BAC above this is deemed as impaired.

The breath samples provided by Housley registered BAC levels of 0.26 and 0.25. These levels indicated that Housley’s BAC was nearly three times the legal limit. Due to the exceptionally high levels of alcohol in his blood, an excessive DUI charge was brought against Housley, which is a felony under Idaho laws. Housley was also charged with misdemeanor possession of an open container.

This isn’t the first time Housley has been charged with driving under the influence. During the last three years, he has previously been charged with DUI twice. This makes his present charge the third DUI.

Idaho has a lookback period of ten years. This means that any DUI offenses that occur within this period add up. The penalties grow stiffer with each subsequent DUI offense.

The penalties for third DUI offense include a prison sentence of up to 10 years and a fine of up to $5,000. However, the actual penalties may be reduced or increased depending on the unique circumstances of the case.
