Understanding DUI Laws for CDL Drivers
Not only are the potential DUI consequences more serious for CDL holders more serious, but the laws themselves are stricter. The standard blood-alcohol content (BAC) level in DUI cases is 0.08%. This means that when a driver is found with BAC levels of that threshold or higher, they can be charged with DUI.
However, the standard is higher for those operating a commercial vehicle—the BAC threshold is lowered to 0.04%. It takes very little in the way of alcohol consumption to reach that point.
Furthermore, while a driver can technically refuse to take a breathalyzer test, there is little incentive to do so. Idaho law says that applying for, and receiving the license, amounts to consent to a breathalyzer test if a police officer with probable cause requests it. A CDL holder that refuses the test will have their operator’s license suspended on that basis alone, even apart from the test results.
DUI Penalties for CDL Holders
The law is straightforward. For a first offense, the CDL license will be suspended for a year. A second DUI offense means the loss of the CDL for life.
Our office can work with drivers to get their CDL back after a first offense. The process simply involves paying a reinstatement fee and providing evidence that fines and any other requirements (i.e., mandatory testing) have been fulfilled.
It also bears noting that the “permanent” CDL suspension following a second offense has exceptions. A driver who waits for 10 years can apply for reinstatement under certain conditions.
The requirements for getting an otherwise permanent suspension lifted include the following, per Idaho law:
- The original suspension must have taken place in the state of Idaho
- They must have their standard Class D driver’s license reinstated for at least three years
- They cannot have served jail time, and there can be convictions of any kind for drug or alcohol-related offenses
- They must show proof of completing an alcohol or drug rehab program
- They must have a clean driving record for that same period
- They must complete defensive driving courses mandated by the state
If these conditions are met, a CDL holder can get a third chance.
