The Penalties for Underage DUI in Idaho
It’s important to note that the blood alcohol content (BAC) level threshold for a DUI is much lower for a minor than for someone who is over the age of 21. For an adult DUI charge, the BAC level must be at least 0.08% to be considered driving under the influence.
However, for minors, even a 0.02% BAC level while driving will be considered a DUI. The consequences of that can include:
- Fines: For first-time offenders, fines could be as high as $1,000, plus a one-year license suspension. For a second DUI charge, fines could go to $2,000, plus license suspension for up to two years. A third DUI can include all of that and six months of jail time.
- Confinement: Those aged 18-20 are at risk of jail time. Offenders under the age of 18 will not likely be tried as adults, but it is possible they could serve out a confinement sentence in a juvenile center.
- Community service: An underage DUI offender might be able to perform some form of community service as an alternative to jail time.
- IID installation: An acronym for an Ignition Interlock Device, IID is a breath analyzer that is attached to a vehicle’s ignition. It stops the car from starting if it detects alcohol in the driver’s breath. Installing this device is one of the penalties for underage DUI in Idaho.

A DUI conviction can be damaging to one’s college application, particularly if that application involves scholarship funding and financial aid. The DUI conviction will come up in a background check.
